Welcome to Feedbes! By accessing or using our services, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before using our app or website.

1. Acceptance of Terms

By using the Feedbes app and website (https://feedbes.in), you agree to these Terms & Conditions. If you do not agree to these terms, please do not use our services.

2. Changes to Terms

Feedbes reserves the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of the app following the changes constitutes your acceptance of the new Terms & Conditions.

3. User Registration

You can use our app without registration until you purchase a product. The details you enter in the registration and delivery address will be your responsibility if any of the details are incorrect. If you open your account on another device and there is a problem with it, you will be responsible for it, not Feedbes.

4. Product Information

All product images, names, pricing, highlights, more product details, descriptions, etc., on the Feedbes website are uploaded from an advertisement perspective. The product you receive may have different packaging from what is shown on the website. This may occur because the product details displayed on Feedbes are not updated, and Feedbes does not confirm these details, as the seller is responsible for uploading the product information. When an update is requested, Feedbes updates the product details accordingly.

Feedbes advises you to carefully read the labels and instructions provided on the product you receive before use. If you encounter any issues, such as the product being used, damaged, incomplete, or having a size or quality problem, the seller will be fully responsible for resolving them. Feedbes' responsibility is limited to the delivery of the product.

5. Order Acceptance and Cancellation

All orders placed through Feedbes are subject to acceptance. Feedbes gives its customers 30 minutes to make any modifications to their order. After 30 minutes, Feedbes confirms the order, and thereafter the customer cannot cancel the order.

Feedbes reserves the full right to cancel your order for any reason, whether it is due to product unavailability, stock issues, or suspicious activity detected.

If your order is cancelled after an online payment, Feedbes automatically checks the order and processes the refund to your account.

6. Payment Terms

Feedbes provides Cash On Delivery (COD) as well as Online Payment options for ordering its products. With Online Payment, you can use various methods, including UPI, Net Banking, Credit, and Debit Cards.

Feedbes confirm the order only after the payment is completed. This condition applies solely to Online Payments.

If you order a product, whether using Online Payment or COD, and refuse to accept the product at the time of delivery, Feedbes reserves the right to block the COD option on your account.

The COD Blocking Policy states that if you have previously ordered a product and refused delivery, Feedbes will block the COD option for your next 4 orders. If you refuse delivery again during this period, Feedbes will permanently block the COD option on your account. Once the COD option is blocked, Feedbes will not reinstate it under any circumstances.

7. Shipping and Delivery

Feedbes delivers its products to selected areas, and the delivery time may vary for each location.

Most of the products on Feedbes come with free delivery. However, if you want to know the delivery fee for a specific product, please open the product listing and check the More Details section at the bottom. Here, you will see whether the delivery is free or not. If this information is not available in that section, please refer to the product description for details on the delivery fee.

8. Returns and Refunds

Feedbes does not allow returns on every product. First, you need to know which products are eligible for returns because Feedbes' return panel records requests for all products. If you submit a request for a non-returnable product without being aware of the return policy, you might face rejection. Therefore, it is essential to identify which products come under the return category and which do not.

To determine this, first, open the product listing and check the More Details section at the bottom. If this information is not visible there, please refer to the product description. This will help you understand which products are returnable and which are not.

If you have returned any product, your refund will be processed after the product is received by the company and will be credited to your given bank account.

If you want to return any product, you must do so within 5 days of receiving it; otherwise, your return request will not be accepted. In some cases, Feedbes may provide a 1-day extension for returns, but this is not confirmed, so it is best to return the product within 5 days.

While returning, please ensure that the receipt is included with the product package.

9. Seller Policy for Feedbes

At Feedbes, we are committed to maintaining the highest standards of quality and customer satisfaction. To ensure this, we have implemented a Seller Policy that outlines the guidelines and responsibilities for all sellers using our platform to submit products for sale.

By becoming a seller on our platform, you agree to abide by the following terms and conditions:

9.1. Seller Eligibility

9.1.1. Sellers must complete the registration process and provide accurate and up-to-date information.

9.1.2. Only businesses with valid GST or other legal business identification will be eligible to submit products.

9.1.3. Sellers are required to maintain compliance with all applicable laws and regulations related to their products and business.

9.2. Product Submission and Approval

9.2.1. All product submissions will be reviewed by our team before they are listed on the website.

9.2.2. Sellers must provide complete and accurate product information, including but not limited to:

  • Product Name
  • Product Highlights
  • Product Description
  • High-quality images
  • Product Return or Delivery Fee
  • Pricing
  • Stock availability

9.2.3. Submitted products will not be listed until they are reviewed and approved by our team.

9.2.4. We reserve the right to reject any product submissions that do not meet our quality standards, violate our policies, or are deemed inappropriate.

9.2.5. Once approved, products will be listed under Feedbes, and sellers will not have the ability to change pricing or product details directly.

9.3. Product Guidelines

9.3.1. Sellers are responsible for ensuring the accuracy of the product details they submit.

9.3.2. Product descriptions must be clear, truthful, and should not mislead customers.

9.3.3. Product images must meet the following criteria:

  • High resolution, with no watermarks or text overlays
  • Accurate representation of the product being sold

9.3.4. Sellers are required to keep stock information up-to-date and notify us of any stock shortages.

9.4. Pricing and Payments

9.4.1. All prices submitted by sellers must be competitive and in line with market standards.

9.4.2. Sellers will be paid based on the agreed-upon commission structure, which will be detailed in a separate agreement.

9.4.3. Payments will be processed within 7 business day’s after the successful sale and delivery of the product.

9.4.4. Sellers are responsible for any applicable taxes on sales made through the platform.

9.5. Quality Control

9.5.1. Our platform reserves the right to request additional information or modifications to any submitted product to meet our quality standards.

9.5.2. Products that consistently receive negative feedback or return requests may be subject to removal from the platform.

9.6. Intellectual Property

9.6.1. Sellers must ensure they have the legal right to sell the products they submit and that the products do not infringe on the intellectual property rights of third parties.

9.6.2. Any violation of intellectual property laws will result in immediate removal of the product and possible suspension of the seller account.

9.7. Seller Responsibilities

9.7.1. Sellers are responsible for ensuring their products meet all legal, safety, and regulatory requirements.

9.7.2. Sellers must provide timely and accurate responses to any queries related to their products.

9.7.3. Sellers must promptly address any customer complaints or issues related to their products.

9.8. Returns and Refunds

9.8.1. All products sold through Feedbes must comply with our return and refund policy.

9.8.2. Sellers are required to process returns and refunds in accordance with our guidelines. Non-compliance may result in penalties or suspension.

9.9. Account Suspension and Termination

9.9.1. Feedbes reserves the right to suspend or terminate a seller’s account for any breach of this policy or any fraudulent or unethical behavior.

9.9.2. Sellers may terminate their account at any time by providing written notice. However, any outstanding sales or commitments must be honored.

9.10. Modifications to the Policy

9.10.1. Feedbes reserves the right to modify or update this policy at any time. Sellers will be notified of any significant changes, and continued use of the platform constitutes acceptance of the revised policy.

9.11. Feedbes Seller Commission Policy

At Feedbes, we are dedicated to maintaining a transparent and fair commission structure for our sellers. Below is an outline of our commission policy, including details on how much commission Feedbes will charge on sales made through our platform.

9.11.1. Commission Rate:

Feedbes will charge a commission of 15% on the total selling price of each product sold through our platform. This commission will be deducted from the seller's payout after the sale is completed.

9.11.2. GST-Registered Sellers:

For sellers who are GST-registered, the applicable commission rates are as follows:

  1. Home & Decor
    1. Commission Rate: 10% (This category generally has a high sales volume and a wide range of price points, so a moderate commission helps seller profitability and business sustainability).
  2. Home Improvement
    1. Commission Rate: 12% (Home improvement items often specialized products, so a slightly higher commission balances operational costs and margins).
  3. Furniture
    1. Commission Rate: 8% (Furniture has a higher average selling price but also involves logistics costs, so a lower commission helps sellers remain competitive).
  4. Outdoor, Lawn & Garden
    1. Commission Rate: 10% (This category sees moderate sales volume and needs to remain affordable for the seller, making a balanced commission necessary).
  5. Electronics
    1. Consumer Electronics (eg., Mobiles, Laptops, Cameras): 5% (The electronics market is highly competitive, and margins can be thin. A lower commission ensures that sellers can remain competitive while you still gain from high-volume sales).
    2. Small Appliances (eg., Mixers, Toasters): 8% (Smaller electronic items generally have moderate margins, so this rate strikes a balance between profitable and sales volume).
    3. Large Appliances (eg., Refrigerator, Air Conditioners): 6% (High-tickets need lower commission to keep prices attractive to buyers, especially in the Indian market where these items are significant purchases.)
  6. Other Electronics (eg., Accessories, Cables)
    1. Commission Rate: 10% (Electronic accessories often have higher margins, so a 10% commission ensures profitability for both sides).
  7. Outdoor Electronics (eg., Cameras, Solar Lighting)
    1. Commission Rate: 8% (This rate balances the higher value of outdoor electronics and the need for affordability in a market-driven category).
  8. Miscellaneous Categories (eg., Gifts, Seasonal items)
    1. Commission Rate: 9% (This category can include various product types, and a moderate commission allows sellers flexibility without feeling under pressure).

Note: Commission rates are subject to periodic review based on market conditions.

9.11.3. Non-GST Registered Sellers:

For sellers who are not registered under GST, the applicable commission rates are as follows:

  1. Home & Decor
    1. Commission Rate: 15% (Higher commission reflects the additional compliance burden, while still allowing sellers to operate profitably in this popular category.)
  2. Home Improvement
    1. Commission Rate: 18% (As this category often involves specialized items, a higher commission ensures Feedbes covers all associated costs without burdening sellers excessively.)
  3. Furniture
    1. Commission Rate: 14% (Furniture requires significant logistical coordination, so a higher commission is necessary to cover operations while maintaining seller competitiveness.)
  4. Outdoor, Lawn & Garden
    1. Commission Rate: 15% (A moderate but increased commission ensures that sellers without GST registration contribute to the operational expenses.)
  5. Electronics
    1. Consumer Electronics (eg., Mobiles, Laptops, Cameras): 10% (This is a highly competitive category, but the increased commission reflects the need to maintain platform profitability, even with non-GST registered sellers.)
    2. Small Appliances (eg., Mixers, Toasters): 12% (For smaller appliances, a higher commission ensures profitability without deterring sellers too much.)
    3. Large Appliances (eg., Refrigerators, Air Conditioners): 10% (These high-ticket items are crucial for sellers, but a 10% commission still reflects the added administrative costs for non-GST sellers.)
  6. Other Electronics (eg., Accessories, Cables)
    1. Commission Rate: 15% (Electronic accessories usually have better margins, so a higher commission for non-GST sellers remains feasible).
  7. Outdoor Electronics (eg., Cameras, Solar Lighting)
    1. Commission Rate: 14% (Outdoor electronics maintain good profitability, allowing for a higher commission without burdening sellers excessively).
  8. Miscellaneous Categories (eg., Gifts, Seasonal Items)
    1. Commission Rate: 16% (Miscellaneous items vary greatly, so a higher commission rate ensures profitability for Feedbes while still allowing sellers to operate effectively).

Notes:

  • This commission structure applies only to sellers who are not registered under GST.
  • These businesses will not receive the same reduced commission rate as GST-registered sellers.
  • The increased commission rate helps cover additional compliance, administrative, and operational costs involved in dealing with non-GST registered businesses.

9.11.4. Transaction Fees:

In addition to the commission, a small transaction fee of 2% (18% GST) may be charged to cover payment processing costs. This fee will also be deducted from the seller's payout.

9.11.5. Payouts:

Seller payouts will be processed 7 to 14 days after the deduction of the applicable commission and transaction fees. Sellers can review their earnings and deductions through their Feedbes seller account dashboard.

9.11.6. Dispute Resolution:

If there is any dispute regarding commission deductions, sellers may contact our support team within 7 days of the transaction. Feedbes will review the issue and respond accordingly.

9.11.7. Updates to Policy:

Feedbes reserves the right to update or modify this commission policy at any time. Sellers will be notified in advance of any changes, and the updated policy will be available in the seller portal.

By continuing to sell on Feedbes, sellers agree to comply with the commission structure outlined in this policy.

10. Return and RTO Commission Policy

At Feedbes, we aim to maintain fairness and transparency in all our dealings with sellers. Below is the policy concerning commission charges on returned and RTO (Return to Origin) products, applicable to all sellers, whether GST-registered or not.

  1. Commission on Returned Products:
    1. If a product is returned by the customer within the allowed return window and is accepted back according to Feedbes’ return policy, no commission will be charged to the seller on that product.
    2. Sellers will only be responsible for any logistics or handling fees related to the return, if applicable.
  2. Commission on RTO (Return to Origin) Products:
    1. In cases where a product is RTO (Return to Origin), meaning the order could not be delivered to the customer and is returned to the seller due to reasons such as incorrect address, customer unavailability, or refusal to accept the package, Feedbes will still charge the applicable commission on the sale.
    2. This commission charge is applied because the transaction is considered complete at the point of dispatch, and resources have been used to facilitate the sale and shipment.
    3. Sellers will also be responsible for any logistics costs related to RTO, including return shipping.
  3. Applicable for All sellers:

This policy is applicable to both:

  1. GST-registered sellers
  2. Non-GST registered sellers

The commission rates that apply to each seller type (as outlined in the Feedbes Commission Rate List) will remain in effect for RTO products.

  1. Return Eligibility:

Product eligibility for return are subject to the return guidelines set by Feedbes. Sellers are encouraged to familiarize themselves with these guidelines to ensure compliance and to minimize returns.

  1. Dispute Resolution:

If a seller believes that a return or RTO has been incorrectly processed, they may raise a dispute with Feedbes within 7 business days of the transaction. Feedbes will review and address any issues in a timely manner.

  1. Updates to the Policy:

Feedbes reserves the right to update or modify this policy at any time. Sellers will be notified in advance of any such changes.

This policy ensures clarity for sellers, with a fair approach to handling commissions on returns and RTOs.

11. User Responsibilities

You agree to use our services for lawful purposes and in compliance with applicable laws and regulations. You will not engage in any conduct or action that brings down Feedbes' reputation. If you make any allegations against Feedbes and are unable to substantiate them with logical and legal proof, Feedbes reserves the right to take legal action against you, which may include a fine of up to Rs 10,000.

Feedbes will also take legal action against anyone who threatens or misleads Feedbes customers or affiliates.

12. Intellectual Property

All content on Feedbes, including text, graphics, logos, and software, is the property of Feedbes or our content suppliers and is protected by copyright and intellectual property laws. You may not use any content without our prior written consent.

13. Limitation of Liability

To the maximum extent permitted by law, Feedbes shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our app or website.

14. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be resolved in the competent courts of Lucknow High Court.

15. MOBILE APPLICATION LICENSE

15.1. Use License

If you access the Services via the App, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on wireless electronic devices owned or controlled by you, and to access and use the App on such devices strictly in accordance with the terms and conditions of this mobile application license contained in these Legal Terms. You shall not: (1) except as permitted by applicable law, decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App; (2) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the App; (3) violate any applicable laws, rules, or regulations in connection with your access or use of the App; (4) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) posted by us or the licensors of the App; (5) use the App for any revenue-generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended; (6) make the App available over a network or other environment permitting access or use by multiple devices or users at the same time; (7) use the App for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the App; (8) use the App to send automated queries to any website or to send any unsolicited commercial email; or (9) use any proprietary information or any of our interfaces or our other intellectual property in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices for use with the App.

15.2. Apple and Android Devices

The following terms apply when you use the App obtained from either the Apple Store or Google Play (each an "App Distributor") to access the Services: (1) the license granted to you for our App is limited to a non-transferable license to use the application on a device that utilizes the Apple iOS or Android operating systems, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor’s terms of service; (2) we are responsible for providing any maintenance and support services with respect to the App as specified in the terms and conditions of this mobile application license contained in these Legal Terms or as otherwise required under applicable law, and you acknowledge that each App Distributor has no obligation whatsoever to furnish any maintenance and support services with respect to the App; (3) in the event of any failure of the App to conform to any applicable warranty, you may notify the applicable App Distributor, and the App Distributor, in accordance with its terms and policies, may refund the purchase price, if any, paid for the App, and to the maximum extent permitted by applicable law, the App Distributor will have no other warranty obligation whatsoever with respect to the App; (4) you represent and warrant that (i) you are not located in a country that is subject to a US government embargo, or that has been designated by the US government as a "terrorist supporting" country and (ii) you are not listed on any US government list of prohibited or restricted parties; (5) you must comply with applicable third-party terms of agreement when using the App, e.g., if you have a VoIP application, then you must not be in violation of their wireless data service agreement when using the App; and (6) you acknowledge and agree that the App Distributors are third-party beneficiaries of the terms and conditions in this mobile application license contained in these Legal Terms, and that each App Distributor will have the right (and will be deemed to have accepted the right) to enforce the terms and conditions in this mobile application licence contained in these Legal Terms against you as a third-party beneficiary thereof.

16. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy: https://www.feedbes.in/privacy-policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. Please be advised the Services are hosted in India. If you access the Services from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in India, then through your continued use of the Services, you are transferring your data to India, and you expressly consent to have your data transferred to and processed in India.
